Acceptance of Terms

By accessing and using this website and engaging services with Kaely Phelps Psychotherapy LTD ("we," "us," "our"), you ("you," "your," "client") accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this website or engage our services.

These Terms and Conditions should be read in conjunction with our Privacy Policy and any other policies or agreements provided to you.

Description of Services

We provide private psychotherapy and counseling services to individuals, couples, families, and groups. Services may be delivered:

  • In person at our therapy rooms

  • Online via secure video conferencing

  • By telephone

All services are provided on a private, direct-pay basis. I do not work directly with insurance companies or the NHS.

Eligibility and Use of Website

Age Requirement: You must be 18 years or older to engage our services independently. Clients under 18 require parental or guardian consent.

Appropriate Use: This website is intended solely for the purpose of learning about and booking psychotherapy services. You agree not to use this website for any unlawful purpose or in any way that could damage, disable, or impair our services.

Account Security: If you create an account on our website or client portal, you are responsible for maintaining the confidentiality of your login credentials.

Booking and Appointments

Initial Consultation: I offer an initial consultation to assess suitability and discuss your needs.

Appointment Scheduling: Appointments are scheduled in advance and are subject to availability.

Session Duration: Standard therapy sessions are 45 or 50 minutes unless otherwise agreed.

Fees and Payment

Fee Structure: Our current fees are displayed on our website and will be confirmed during the initial consultation. Fees are subject to change with reasonable notice.

Payment Methods: Payment is accepted via card payment and payment is due at the time of session.

Late Payment: Failure to pay fees on time may result in suspension of services until payment is received.

No Refunds: Fees for completed sessions are non-refundable.

Cancellation and No-Show Policy

Cancellation Notice: I kindly request at least 48 hours' notice to cancel or reschedule an appointment.

Late Cancellation Fee: Cancellations and reschedules made with less than 48 hours' notice will be charged the full session fee.

No-Show Fee: Failure to attend a scheduled session without prior notice will result in a charge of the full session fee.

Therapist Cancellation: If I need to cancel a session, I will provide as much notice as possible and will not charge you for the canceled session.

Exceptions: We understand that emergencies happen. Exceptional circumstances are rare and will be considered on a case-by-case basis.

Confidentiality

General Confidentiality: All information shared during therapy sessions is confidential and will be handled in accordance with our Privacy Policy and professional ethical guidelines.

Limits to Confidentiality: Confidentiality may be broken in the following circumstances:

  • When you provide written consent

  • When required by law or court order

  • When there is serious risk of harm to yourself or others

  • When there is suspected abuse of a child or vulnerable adult

  • In the course of professional supervision (with identifying information minimized)

Therapeutic Relationship

Professional Boundaries: The relationship between therapist and client is professional and confidential. We maintain clear boundaries and do not engage in dual relationships.

Outside Contact: Communication outside of scheduled sessions should be limited to brief administrative matters such as scheduling. We cannot provide therapy support via email or text message.

Social Media: We do not accept friend or contact requests from current or former clients on personal social media accounts.

Gifts: We appreciate the sentiment, but we cannot accept gifts from clients beyond token items of minimal value.

Client Responsibilities

You agree to:

  • Attend scheduled sessions on time

  • Provide accurate information relevant to your treatment

  • Pay fees as agreed

  • Inform us of any changes to your contact details or circumstances

  • Engage actively and honestly in the therapeutic process

  • Notify us if you wish to end therapy​

 

Therapist's Right to Refuse or Terminate Services

I reserve the right to decline or terminate services if:

  • I determine that I am not appropriately qualified to address your needs

  • There is a conflict of interest

  • The therapeutic relationship has broken down

  • You breach these Terms and Conditions

  • You engage in threatening, abusive, or inappropriate behavior

  • Payment obligations are not met

In such cases, I will provide appropriate referrals where possible.

Limitations of Service

Not Emergency Services: Our services are not appropriate for crisis or emergency situations. If you are in immediate danger, please contact emergency services (999 in UK, 911 in US) or crisis helplines such as Samaritans (116 123 in UK) or National Suicide Prevention Lifeline (988 in US).

Not a Substitute for Medical Care: Psychotherapy is not a substitute for medical treatment. We may recommend you consult with a physician or psychiatrist where appropriate.

No Guarantees: While we aim to provide the highest quality care, we cannot guarantee specific outcomes from therapy.

Intellectual Property

Website Content: All content on this website, including text, graphics, logos, and images, is the property of Kaely Phelps Psychotherapy LTD and is protected by copyright laws.

Prohibited Use: You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.

Client Materials: Any materials you provide during therapy remain your property. We may keep copies as part of your clinical record.

Liability and Disclaimer

Professional Standards: We provide services in accordance with professional standards set by UKCP and the ASWB.

Limitation of Liability: To the extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services or website.

Website Availability: We do not guarantee that our website will be available at all times or free from errors or viruses.

Online Sessions

Technology Requirements: You are responsible for ensuring you have appropriate technology, internet connection, and a private space for online sessions.

Technical Issues: The practice is not responsible for technical difficulties that prevent or interrupt online sessions. In case of technical failure, you will still be responsible for the full session fee.

Security: We use encrypted, HIPAA and GDPR-compliant platforms for online sessions. However, no internet communication is 100% secure.

Location: You must inform us of your physical location at the start of each online session for safety purposes.

Data Protection

We collect and process your personal data in accordance with our Privacy Policy and applicable data protection laws (UK GDPR, Data Protection Act 2018, and where applicable, HIPAA).

Complaints and Disputes

Internal Complaints: If you have concerns about services, please contact me directly at hello@kaelyphelpstherapy.com. I will attempt to resolve issues informally where possible.

Professional Bodies: You may also lodge a complaint with professional regulatory body: UKCP and NYSED.

Jurisdiction: These Terms and Conditions are governed by the laws of England and Wales and New York State.

Dispute Resolution: We encourage resolution of disputes through direct communication. If necessary, disputes may be subject to mediation before legal proceedings.

Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this website with the "Last Updated" date revised. Continued use of our services after changes constitutes acceptance of the modified terms.

For material changes affecting existing clients, we will provide direct notice via email or during your next session.

Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any written agreements signed by you, constitute the entire agreement between you and Kaely Phelps Psychotherapy LTD regarding the use of our services.
